Experience
- Our team acted for a large, global water treatment solution provider in relation to numerous infrastructure projects across various industries and global locations with a particular focus on the mining and energy sectors. This has included full project lifecycle management, from procurement planning workshops with our client’s project delivery and executive teams, go to market strategy, risk assessments, contract mapping, head contract negotiations, subcontract and subconsultant engagement and negotiations, early works engagements, and early contractor involvement in design finalisation and specialist equipment procurement.
- We have acted for, or negotiated with, government and drafted documents in respect of the provision of public services and infrastructure for major development projects including wastewater, schools, roads, flood mitigation and related infrastructure including, in recent times, for the various wastewater treatment plants, the Two Wells and Roseworthy Township Expansions and the proposed Gillman development.
- We have acted for a specialist infrastructure provider in relation to the establishment of an unincorporated joint venture under Australian laws for the delivery of a significant infrastructure project Europe. With our client as the non-lead party, this has involved extensive risk management through the joint venture agreement to ensure head contract risk and flow down to our client has been appropriately managed, whilst maintaining a strong and collaborative working relationship with the joint venture counterparty to support successful project delivery for the client.
- We regularly act for both principals and contractors in the delivery of $20-$40m capital projects, under a range of different delivery models and utilising various different contract forms, depending on the nature, size, risk and urgency or the project, including:
- a large, national manufacturing organisation on the delivery of a significant new manufacturing and warehouse facility in Queensland, with works undertaken under an early contractor involvement agreement, with inputs forming the basis of a full design and construct contract utilising AS4902;
- a specialist contractor in NSW in relation to the delivery of:
- critical transport related infrastructure; and
- processing facilities at a large waste retrieval site in outer-metropolitan Sydney.
- We regularly work with our clients to assist them with updates to their suite of construction documents, including AS documents, supply with / without installation contracts, consultancy and commissioning services agreement, minor works templates, standing offer agreements and standard sales and procurement terms, all with a view to helping them drive future efficiency and self-service – a reflection of our commitment to genuinely partnering with our clients to deliver long term value for money.
- We acted in all aspects of major broad acre residential development projects, including negotiations with government, councils and landowners, infrastructure development and delivery.
- We prepared terms of contracts providing for the undertaking of extensive rectification works.
- We assisted a client in a claim for approximately $10 million by a contractor engaged to provide mining services, including provision of labour, equipment, and materials for the performance of underground mining operations at a gold mine.
- Our team represented a waste management and recycling business before the Supreme Court in relation to the defective construction of its significant processing facility.
- Our team acted for a large civil construction contractor in relation to a multi-million dollar dispute in the Supreme Court of South Australia, in respect of monies paid pursuant to latent site conditions, also involving providing life cycle project management and risk minimization advice.
- Our team represented a multinational technology company in a variety of project life cycle disputes about the construction of a large prison, including providing project management, risk minimization and dispute resolution advice, and successfully defending several large multi-million dollar adjudication applications under the Building and Construction Industry Security of Payment Act.
- We act, and have acted, for a major national homebuilder in building disputes about alleged defects, variations, extensions of time, and cost recoveries.
